Acceptance of Terms

By accessing or using this website (“Site”) or engaging with any services provided by Next Phase Exterior Remodeling, LLC (“we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, do not use the Site or request services.

Services Provided

We provide residential exterior remodeling services including but not limited to roofing, siding, windows, doors, and general exterior improvements. All services are subject to a signed Construction Contract Agreement, which governs the scope of work, payment terms, warranties, and other legal obligations.

Promotional Offers

From time to time, Next Phase Exterior Remodeling may offer special promotions in addition to our standard terms and conditions. The following applies to our current limited-time offer:

25% Off Exterior Services Promotion
Offer valid for a limited time only. Receive 25% off all exterior remodeling services with a minimum purchase of $7,500 (before discount). For door installation services, a minimum purchase of $5,000 applies. Discount applies to the base contract amount and excludes additional fees, taxes, or upgrades. Offer is valid on new contracts only and cannot be combined with any other discounts, promotions, or special offers. Financing option of no interest and no payments for 12 months available to qualifying customers. Next Phase Exterior Remodeling reserves the right to modify or terminate this promotion at any time without prior notice.

Free Patio Door Promotion – Terms & Conditions
Customers are eligible to receive one (1) free standard patio door with the purchase of either (a) ten (10) or more replacement windows in a single order, or (b) a full roof replacement. This promotion is valid only on contracts signed through September 15th. A minimum order of $8,000 is required. Limit one free patio door per qualifying project. The promotion is subject to company approval and may not be combined with any other offers, discounts, or prior purchases. Patio door style and size are limited to standard options; upgrades or customizations may incur additional charges. Installation must be performed by the company’s authorized installers. Additional restrictions may apply.

Estimates and Pricing

All estimates are valid for thirty (30) days from issuance and are subject to change due to unforeseen conditions, scope changes, or material cost escalations. No contract shall be considered binding until signed by both parties.

Important Note: Pricing may increase if material costs rise after the contract is signed. You will be notified and may choose to proceed with revised pricing, change the materials, or cancel the project (see Section 6).

Financing and Lien Notice

If you finance your project, please be aware:

This contract may create a lien or mortgage on your home. Failure to pay as agreed may result in loss of your property.
Contracts financed through third-party lenders are not binding until financing is approved and accepted by both you and Next Phase. Additional documents may be required, and financing terms are governed by the lender.

Right to Cancel

In compliance with Maryland’s Door-to-Door Sales Act:

You may cancel any agreement within five (5) business days from the date of signing.
If any homeowner is aged 65 or older, the cancellation window is seven (7) business days.

Payment Terms

Payment terms are detailed in the Construction Contract Agreement. Generally:

A non-refundable deposit of up to 1/3 of the contract price may be required under Maryland law.
Invoices are due within five (5) days of receipt.
Late payments incur a 5% per month penalty.
Credit card payments incur a 4% processing fee.

Failure to make timely payments may result in work stoppage, cancellation, or legal recovery efforts.

Client Responsibilities

You agree to:

Provide clear access to the project site during working hours (typically Mon–Fri, 8AM–6PM).
Remove personal items, pets, and valuables from work areas.
Supply access to water and electricity for construction use.
Obtain and maintain a valid homeowner’s insurance policy.

You are also responsible for compliance with zoning laws, HOA rules, and property boundary restrictions.

Construction Conditions & Limitations

Construction may involve noise, dust, and vibration. We will make reasonable efforts to protect your property, but are not liable for incidental cosmetic damage (e.g., cracked drywall, disturbed landscaping).

You acknowledge that:

Concrete and natural materials may crack, discolor, or chip over time.
These occurrences are not covered by warranty.

If unexpected subsurface or structural conditions arise, you will be notified and may:

Approve additional costs
Hire a third party (if compliant)
Cancel the contract (subject to costs incurred to date)

Warranties & Exclusions

We warrant that all work will be completed in a professional and workmanlike manner. However:

No warranty applies to natural product defects (e.g., wood grain, stone variances).
We do not warrant against concrete cracking or similar natural settling issues.
Alterations by others or failure to maintain the project voids the workmanship warranty.

Manufacturer warranties for products may apply and will be passed through to the homeowner.

Force Majeure / Project Delays

We are not liable for delays or performance failures due to events beyond our control, including but not limited to:

Weather
Supply chain issues
Labor shortages
Utility disruptions
Government delays
Pandemics or public health orders

Delays do not entitle you to contract termination unless otherwise agreed in writing.

Limitation of Liability

Our total liability under any contract or use of our Site is limited to the total amount paid by you under the Construction Contract Agreement.

We are not liable for any incidental, consequential, or indirect damages, including lost use, lost income, or costs to replace third-party work.

Dispute Resolution & Governing Law

Before pursuing legal action, you agree to attempt resolution through good-faith mediation, which may be administered via the Maryland Home Improvement Commission (MHIC).

If unresolved, all disputes must be filed in:

District or Circuit Court of Baltimore County, Maryland

Each party is responsible for its own legal fees, regardless of outcome. You expressly waive the right to trial by jury.

Privacy Policy

We collect and use your personal data in accordance with our [Privacy Policy], including your name, address, phone, and project information. We do not sell or share your personal data without consent.

Communication Consent

By contacting us or submitting a quote request, you consent to receive emails, calls, and text messages about your project or related offers. You may opt out by replying “STOP” or emailing us.

Updates to Terms
